Question
I have an account that has gone into collections and is way beyond my means to pay. The collection agency is demanding over $14,000 and I make barely $5,000 a year. I own no property other than my car. I've sent several letters asking them to settle for a lower amount, but they never respond, instead I get letters from them saying I am ignoring their letters and they raise the amount I owe. I just want to know what the law says in California. If I don't pay what can they do to me? Can they take my car away? I'm unemployed currently and just have my unemployment check coming in. Can they take my unemployment? I appreciate any help you can give me.

Answer
Dear Myron,

Thank you for your question.

The agency can not take your unemployment, it's exempted form levy or garnishment.

The agency can obtain a judgment and "sit" on it until you're employed.

The letters you're receiving are system generated, their software is designed to sent letters at certain times during the collection cycle.
