Question
My spouse incurred student loans many years before we had even met.  His salary is garnished at 15% to repay the old loans as he had defaulted on repaying them.

Is my income at risk also?  I do not wish to be held responsible for these debts.  Is there anything I should do to protect myself?

Dear Kathy,

Thank you for your question.  Your income is not at risk.

However your bank account may be.  If you and your husband share an account they may place a levy on all deposits.

Make sure you have a separate bank account until the student loan is paid off.
