Question
I signed a contract with bally's total fitness, i was allowed 5 days to sign a paper changing or cancelling the contract. 2 days later, I signed the paper changing the contract. They "lost the paper" 6 months later, never filed it.  I stopped paying on the grounds that they breached the contract, after fighting with them for 6 months.  They sold my account to a collection agency, it is ruining my credit and they are calling all the time, what are my rights?

Amanda:

Your first move should be to dispute it with the credit reporting agencies.  Do so in writing.  If it's verified, then consult with an attorney.

Your second step should be to request validation with the debt collector.
