Question "Hello, thank-you for your time. My name is Jeff, we moved from Texas 3 years ago (2006),to Hamilton Ontario, Canada.both my wife and I are Canadian Citizens. We had a $10000.00 small business loan through Texas State bank, this loan was given to us as a unsecured loan with no conditions,we were paying on time prior to moving, and have not paid since moving.the bank was sold to compass bank, then the loan sold to Ltd financial, they have been on us every day for the past week saying they will sue.what to do? do I pay them full? cents on the dollar? can they sue us in Canada? please help..thank you-losing my mind"
Answer Jeff,
The short answer is "yes" it is possible that they could sue in Canada. They would be subject to the civil rules and procedures of Canada so you may want to seek the counsel of a local attorney.
Since the loan amount was small ($10K and under) then it might not be cost effective for them to go after you in Canada.
I will always say that if you owe someone money you should expect to settle with them as it is your obligation to pay something back if not the full amount.
In this case, you could hire ((214) 552-6647) a law firm like mine to negotiate for you or you could do it yourself. You can find a debt settlement sheet at: www.henleycreditlaw.com/pdf/DebtSettlmentSheet.pdf
