Collections Law - garnishment after dismissal????

Question
My fiancee has a credit card that has gone into collection. It went in front of a judge over a year ago and was dismissed. A week ago this same credit card judgement was served on him stating that he was now to be garnished for it. How can he be garnished for something that was already before the judge and was dismissed a year ago???? Help please.

Jennifer:

It was likely that it was dismissed "without" prejudice which permits the creditor to bring the claim back once more.  It sounds as though this time the creditor served your fiancee and he failed to respond and as a result a default judgment was rendered.

I would consult an attorney.  If you're in Tennessee, we may be able to recommend a few good consumer attorney's.
