Question
I am legally divorced but no settlement.  We joint own a piece of real estate and we are both on the mortgage.  There is a good percentage of equity in the property in excess of the mortgage debt.  If I stop making payments...I assume the mortgage company will look to my x to make the payments. If he does this will just go on and on...like it has been for the last 4 years.  Is there any way to force the sale so I can get rid of the debt?

Answer
Ruth,

Inside the state of Texas, you can legally force the sale of a property by filing a lawsuit against the ex.

If you are in Texas, our law firm would be willing to offer a free consultation and let you know the process. If you are not in Texas please seek the counsel of a local real estate or family attorney.
