Question
I received a Civil Summons yesterday and don't know what to do. I lost my job in 2007 and tried to keep up but was not able to I lost my home and still have not found a job. I really can't afford to pay. I just started receiving Social Security can the garnish that? I thought I read that they couldn't but if its direct deposited into my bank account are they able to take it from that? Can they take my vehicle or personal property? What should I do? I would really appreciate any help.. Thanks in advance!

Answer
Dear Sir or Madam:

You present many questions.  Generally, no, SSD or SSI cannot be garnished.  Just to be safe, I would suggest placing your money in a bank out of the town in which you live.  I would not have it direct deposited either.

With that said, we at Barnette Law Offices may be able to assist you with Midland Funding insofar as we do accept consumer protection cases.  We litigate against this debt purchaser on occasion and typically, we do so on a contingency basis (free for our clients).  If interested, you would need to contact us and schedule a consultation.
