Collections Law/Auto Loan Maturity payment and disputing alleged late fees

Question
I am at the end of my term with Capital One Auto Finance and was recently informed that I have a remaining balance of $2k on the loan that had matured.  Capital One indicates that I also have late fees accrued of $1k. I'm disputing these fees.  As per the instruction of the Capital One Rep. I make a personal check and for the principal amount due and send a letter specifically requesting that this payment is for the principal amount that has matured only.  Later, I receive a phone call from Capital One saying that they could not apply the payment in the manner that I'm requesting.  They are very unprofessional and hard to deal with. No contact with professional or seemingly qualified personnel has occured. Reading other posts, I see that others have had many problems with this company. I'm about to retain an attorney to handle this matter.  Please advise accordingly before proceeding.  Your assistance is appreciated

Answer
It sounds like you have done the right thing. I have read many of the same comments about Capital One Auto Finance.

I hate to say I have no better advice than to keep on it. I am not sure what the circumstances are for disputing the late fees so I can not speak to the rest.
