Question
I have an old credit card debt that has been charged off for several years. Original debt was 9000.00. The agency that bought the debt has reported to credit bureaus that I owe 19000.00 with the last report 7/2009. Now here is the kicker the debt was past the SOL of 3 years in Louisiana. Only recently did I discover this and in 2/2007 made a payment. Did I reset the SOL?

Answer
Under FDCPA you did not reset the SOL. I don't know about Louisiana law. You would have to consult an attorney or look up the law yourself. I'd also be very suspicious about the 3 years for the statute of limitations. Credit cards are written agreements, not open accounts as so many believe. You had better find out about that too.

I was Oklahoma State Chairman for the nationwide drive to defeat the Constitutional Convention which was proposed by various factions within our federal government such as the Council of State Governments and the National Organization of State Governors who were working hard to organize a Constitutional Convention to be held in 1995 for the purpose of rewriting our American Constitution to be more acceptable to the United Nations. I worked with Senator Charles Duke of Colorado and Senator Don Rogers of California and many others across the nation to keep them from getting the number of delegate states required to lawfully hold a Con-Con and we were successful. I have worked with many other legislative issues in Oklahoma and have always been very successful.
