Question I live in Ohio. In approx. 1998/1999 I got a computer while I was in college from IBM. I made several payments and then defaulted. After that I received collection notices from them I'm sure at first.. and never made any additional payments...I am sure it went to collections...unfortuanately did not pay those (obviously). For several years I would see the amount of $5000+ on my credit report (which I knew was from this college purchase which was not originally $5000 even with interst) but it appeared several times on one credit report with the same amount under different names...(obviously sold over n over)well still now several years later all are gone except for one which I see from Fan Distributors LLC? for what looks like the original amount about $2700. They filed a judgement in 2004 in Akron Municipal court I never went.. and just looked it up online and it was dismissed in 3/2005. Ok, know after all that (Im sorry) can I get this removed from my credit report (which states it will be removed in 7/2011)using SOL since the original account was most likely charged off and last payment made even if I did pay a collection agency even one payment would have been 9-10 years ago...and I am real certain I never had contact with this FAN LLC. I have no remaining paperwork even from the original purchase. If I contact the credit bureau with a dispute in general what should I state to them...or even acknowedge the debt first of all...and will this FAN place be contaced and be able to restart their collection of filing again if they get my new info somehow. I do so appreciate any advice you can give... and look forward to sharing this site with others. Thank you in advance.
Answer dispute the debt with the credit bureaus as being past sol for listing and if that don't work then file a federal lawsuit against the collection agency and the credit bureaus. You don't need a lawyer but if you don't know how to file a federal case I can teach you how to do that.
Debt Collections law, Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), federal law, how to properly answer court summons for collection cases, how to prepare federal cases against debt collectors, how to deal with debt collection phone calls.
Experience
I've been an active consumer advocate for more than 40 years and have helped hundreds of people win cases against debt collectors as well as helping them defeat demands for summary judgment lodged against them by banks, debt collectors and defeat mortgage foreclosures and keep their homes.
Education/Credentials Paralegal courses for the most part. I have been teaching people how to deal with judgments, mortgage foreclosures and other such problems both on and off the internet for many, many years. I am a Richard Cornforth information provider ever since 2000 and worked with many other organizations and causes since 1980. I was Oklahoma State Chairman for the nationwide drive to defeat the Constitutional Convention which was proposed by various factions within our federal government such as the Council of State Governments and the National Organization of State Governors who were working hard to organize a Constitutional Convention to be held in 1995 for the purpose of rewriting our American Constitution to be more acceptable to the United Nations. I worked with Senator Charles Duke of Colorado and Senator Don Rogers of California and many others across the nation to keep them from getting the number of delegate states required to lawfully hold a Con-Con and we were successful. I have worked with many other legislative issues in Oklahoma and have always been very successful.
