QUESTION: My wife said a sheriff's deputy came by to serve important documents and would not leave them with her.  He said they were from Citibank.  I have a number to call to make arrangements to get these papers.  I live in Texas and would like to know what I need to do.

ANSWER: First of all, don't call the number. Secondly, go to the clerk of the court and ask to see your public record. They will show you that on a computer screen. Look for that judgment and then get copies of all the paperwork in the file. Then you can learn what you need to do by going to this web page.

The whole point of doing it that way is to get the jump on the lawyer with discovery and response. He won't be expecting it to happen and you will gain valuable time.

QUESTION: Ok.. so he called and got the papers before I could tell him not too! So now what?

Answer
Now you should respond to the complaint as outlined in the links I gave you above. He will need a graduated denial, a demand for validation, a certificate of mailing and his demand for admissions. I've explained all of that in the links so I don't have to do it over and over and over again.
