Question
In the state of Ca can a debt collector for a credit card company attach your checking account if social security is your only means of income?

Answer
Sheila,

The answer is that your SS payments can not be garnished not taken out of your bank account. I would first go to the bank and let them know what has happened. Take your SS benefits letter to them and show them how much is being deposited each month due to SS. Next contact the debt collector via certified mail and let them know that they have taken SS funds. and demand a refund for those funds.

If you need more assistance after conducting those steps, please call me at (214) 552-6647
