Question
I received a call the other day from a Collection agency stating that I owe a credit card for one that I don't remember ever getting.  Anyway that said that they were goping to take me to count and put a lein on my house.  Can they do that since supposedly the credit was unsecured?

Hi Betty:

In most states, they can do that.  This is done by taking you to court and getting a civil judgement against you.  If your state allows it, liens on real estate can be one of the collection techniques used to collect on the judgement.  Others include wage garnishment, attacking bank accounts, and even taking personal property for sale through the sheriff's office.  Again, not all these techniques are allowed in all states and there are exemptions but they are possible.

You should avoid getting a judgement against you at all costs.  Use delaying tactics, settlement or even bankruptcy if you are worried about these collection actions.
