I HAVE 3 ACCOUNTS ON THE SAME COLLECTOR AND THEY SAY IM IN COTENT OF COURT AND I HAVE OTHER DEBTS!! QUESTION CAN I NOW FILE FOR BANKRUPTCY? NOTE .. I'M MARRIED, WIFE WORKS AND WE HAVE A DAUGHTER!! I'M ALSO IN THE ARMY IF THAT CAN HELP.. WHAT ARE MY OPTIONS?

You can file bankruptcy at any point and if you qualify for chapter 7, it will likely alieviate any unsecured debt.  You should also look into various programs for military personnel serving overseas that help people in your situation.  I have been told military counselors and commanders can assist in directing you to the proper program.  However, these are often delaying programs so a chapter 7 may still be your best option.

You should be aware that contempt of court is a criminal charge.  Collectors cannot charge you with contempt of court, only a judge or prosecutor can.  So if you have been charged with a CRIMINAL charge (I believe it is unlikely), chapter 7 will not stop that but can eliminate the underlying charge and get it vacated.

Good luck - thank you for your service to our country!  This creditor seems over-bullying.  Please feel free to contact me again with more specifics and I will be glad to help in more detail.  It seems likely to me this collector may have violated the FDCPA.  I have no specific evidence based on what you are saying, but am suspicious of their claim of contempt.  Sometimes it is best to fight back at these guys but I would need more information.
