Question
Hello,
I went to work and I must have left one of the doors open because a title loan agency called me saying that they had my title to my car and my signature on some paper work and I owe 800 dollars and have not made a payment in 2 month. I had a title loan with them before but I did not sign or apply for the one they are talking about. When I went to look for my title in my car it was gone. The motor recently went out on the car and I have it in the shop but I am scared they will come get it. They have tolled me over and over its there car if I don't pay it and I keep telling them they have my signature on file and its not mine. Can they take my car or is there anything I can do?

Answer
Hi:

You need to call the police or local law enforcement in your jurisdiction and tell them of the crime.  You may have to fill out a sworn complaint or some type of affidavit of forgery.  Bring that paperwork to the lender.  You will also likely need to go to the department of motor vehicles and try and get the title situation straightened out.  Just tell them the truth.  Even that the title was stolen.  Bring the police paperwork.

At this point, your car could be at risk of being repossessed.  You need to do this quickly.  Once you get that crime in the system, you could be afforded some measure of protection on the vehicle.  They - police and motor vehicle department - can also advise you on how to proceed.

Good luck,

Expertise

I can answer questions on collections, repossessions, bankruptcy, credit repair, credit counseling, FICO scores, credit planning, and the cause and effect of credit related decisions. I can also answer questions on collection settlements and preparing to sue your creditors for false debts and credit credit reporting.

Experience

Fifteen years ago I was financially devasted due to severe health issues. I filed bankruptcy, had a foreclosure, car repossession, tax lien, and ruined credit. I immersed myself in credit law. I settled dozens of accounts and had them removed to improve my credit. I personally sued four creditors and collection agencies and won cash settlements for their false reporting on my credit reports. Since then, I have completely recovered and have nearly $100,000 in revolving credit lines and perfect credit. I have owned a credit repair company for the past five years and have an additional three years of specific work in the collections and debt management industry. I am fully versed in the Fair Debt Collection Practices Acts (FDCPA), Fair Credit Reporting Act (FCRA), and have used them successfully in collection settlements and lawsuits for myself and others. I am also familiar with and abide by the Credit Repair Organizations Act (CROA). I have deleted or helped delete literally hundreds and hundreds of derogatory items from consumers' credit reports and helped negotiate many settlements with collection agencies and creditors. I have also advised people on bankruptcy at any stage. In the current credit market, I have successfully advised numerous people on how to obtain credit and how to negotiate for better terms.
