Question
I had a Final Judgment filed against me August 25, 2005 by a credit card company.  They assigned it to another company in 2007.  I just received paperwork from an Attorney, in Florida, representing the new company asking me to complete more Interrogatories within 30 days in front of a Notary ands return them to them.  I checked the Court records and I do not see this new companies name on my case.  They called (the Attorney's office in Florida)and said I still have to fill them out.  Questions 1) I filled these out back in 2005.  Do I have to fill them out again since the Final Judgment has already been filed?  2) What can they do to enforce the Final Judgment?

Do you live in Florida? Are you the head of household? Are you on any kind of government pension?
The answer to those questions can give rise to some protections you may have. In any case you must answer the questions in most cases and if you dod by En't you can go to jail for contempt of court. There are many things they can do to enforce the final judgment but there are also many things you can do to protect your assets and income from garnishment. Don't have any money in any bank account and don't be on joint accounts with anyone else, not even minor children as guardian of their accounts. Don't get paic by EFT from any employer. How you answer those questions is also vitally important and if any of them are unreasonable or overly burdensome or expensive to comply with you might be able to seek injunctive relief from the court to keep from having to comply with their demands for information. If you have to go to court be sure you take a court reporter with you. It isn't expensive and can serve to keep you out of a lot of trouble. Again, there are a great number of ways to keep them from getting anything out of you and some of them are pretty tricky. While you are well advised not to make any false statements in responding to their demands for information that doesn't mean you have to give them all the information they might desire either.
