Question
If an outbound call is made and a third party answers phone stating the customer is not available, we ask if we can leave a msg. The third party states at that time they want to make a payment with "Company" and know all the information to make a payment on the phone. Because this is an outbound call, is the "Company" obligated to state the Recording Statement, "This call may be monitored and or recorded for quality purposes.
Sounds to me like you are a debt collector trying to figure out how to comply with the law. If that is true then the best advice I can give you is to be absolutely certain you are talking to the correct party or you could be in for a federal lawsuit. I would not want to take any chances if I were you.

I was Oklahoma State Chairman for the nationwide drive to defeat the Constitutional Convention which was proposed by various factions within our federal government such as the Council of State Governments and the National Organization of State Governors who were working hard to organize a Constitutional Convention to be held in 1995 for the purpose of rewriting our American Constitution to be more acceptable to the United Nations. I worked with Senator Charles Duke of Colorado and Senator Don Rogers of California and many others across the nation to keep them from getting the number of delegate states required to lawfully hold a Con-Con and we were successful. I have worked with many other legislative issues in Oklahoma and have always been very successful.
