QuestionMe and my husband had a bank account with WAMU now CHASE, my husband overdraft that account for some mistakes that he did, then we had financial problems and we couldn't repay that money back, and we filed bankrupcy last year in the month of may, and when the collection department of chase contact us we give then the information of the lawyers and the file # as they ask us, and they closed the account in august; and we put on hold the bankrupcy file for our financial problems and another personal problems but the lawyers told us that we can re-open the file whwn we get ready to continued with the fees of the bankrupcy.
Then in the month of august I opened another account with CHASE but only under my name because I have a child with disability problems, so the social security recomend me to open a bank account for de SSI benefits of my child, and that account is just for my son money and expenses, but now the bank go thrue that account and took over $1100.00 and put it in the other account without asked me o contact me, and when I saw the bank statement and call them they told me that they transfer than money to the account what me and my husband was overdraft in the past; and I explain them that we give them the information of the bankrupcy file and lawyers and they said that they don't have that information in theirs records, they said that they need it again and they gonna see if they can returned that money to the account.
I what to know if is a good possibility that they returned that money back, because the file of brankrupcy is re-opened already now, and what can I do, because me and my husband are unemployment
right now and we don't have how to pay back more money because now this new account is overdraft because they took the money. Thank you
AnswerRosa,
Tell Chase that the money was for SSI which they can not take. You may need to fax them the SSI statements to show what was deposited. They should return the money to the account.
If they still will not return the money, then contact a local consumer attorney at www.naca.net.
