Question
I live in North Carolina.  My checking account has only social security and 2 private pensions directly deposited.  Can creditors put a freeze on my bank account.  I realize they can can put a lien on my house; however my home is equity stripped as I have a second mortgage.

Answer
They should not be able to but mistakes happen.  Make sure that ONLY those funds have EVER been deposited in that account.  Even a $5 cash deposit can technically give the loophole - as silly as that sounds.

I would also put the bank on notice through a formal letter what type of funds are in this account.  Even make them put a note on the account to try and reduce human error.

Remember, creditor can only put a freeze on your account if a court-ordered judgement is in place.
