Question
I got a letter from LBN on 3/10/10, saying I owe $10,400 dollars to FIA Card Services, It had a file Number from LBN. I sent a request for debt validation on 3/22/10. They responded on 3/26/10 with a computer generated letter, The original creditors name (BOA),  with the total amount due, the last 4 of my SSN and a incorrect account number for the credit card number. I responded back with a Notice of Insufficient Verification because any one can get basic info like the last four of a SSN. They do not even have a correct account number from the credit card company. I did reject LBN attempt to validate, and stated that they must remove the collection from my credit report or I will file lawsuit. What actions might I start to prepare for that might help to protect my rights?

Answer
You should not have disputed their debt validation attempt. You can also expect that they will quickly file a lawsuit against you. What actions might I start to prepare that might help protect your rights? Right now I would suggest that you do nothing at all. In fact, you already did more than you should have. The idea of trying to protect your rights is not quite the right way to look at it. I'm not going to give you any hints or helps in this forum because I have a case going with them right now and since a great deal of what I post here finds it's way into Google search results very quickly I'd only be giving them a heads up on what I will do next. I have filed my response to the court so right now I'm just waiting for their next move. Of course, I already know what that is likely to be but maybe they will come up with something unexpected. I'm not worried about what that might be however because I have something up my sleeve that they have probably never had done to them before. It should be fun and should make them very, very angry. So because I have an ongoing case with them I'm not going to be talking about it here. I'm sure they Google their name and maybe mine too in order to see who is talking about them and what is being said about them. If you want to learn what I'm doing and what happens you will have to call me at (405) 237-2174.

Experience

I've been an active consumer advocate for more than 40 years and have helped hundreds of people win cases against debt collectors as well as helping them defeat demands for summary judgment lodged against them by banks, debt collectors and defeat mortgage foreclosures and keep their homes.

Education/Credentials
Paralegal courses for the most part.
I have been teaching people how to deal with judgments, mortgage foreclosures and other such problems both on and off the internet for many, many years. I am a Richard Cornforth information provider ever since 2000 and worked with many other organizations and causes since 1980. I was Oklahoma State Chairman for the nationwide drive to defeat the Constitutional Convention which was proposed by various factions within our federal government such as the Council of State Governments and the National Organization of State Governors who were working hard to organize a Constitutional Convention to be held in 1995 for the purpose of rewriting our American Constitution to be more acceptable to the United Nations. I worked with Senator Charles Duke of Colorado and Senator Don Rogers of California and many others across the nation to keep them from getting the number of delegate states required to lawfully hold a Con-Con and we were successful. I have worked with many other legislative issues in Oklahoma and have always been very successful.
