Question
I live in MI. I leased a vehicle from GMAC in 2005, they wrote off my account in 2006 as a profit and loss writeoff.  It was transferred to West Asset Management, I enrolled in a DMP and $ was being sent monthly.  I was told GMAC pulled it from West Asset because they were not happy with the monthly amount.  After a few months I received a phone call from Accounts Receivable Technologies.  They have called repeatedly (27 times in the last 9 business days.)  I have requested they send the info by mail (they said they have, I've received nothing.)  I have told them I do not have the $ to pay off the debt, they said they won't do payment arrangements. What can I do at this point?

Answer
I'd use informal bankruptcy on them. 27 times in 9 days is illegal harassment and you could sue them for that. Also you need to send a demand for validation. I'd also check with lawdog.com to see what the statute of limitations is in MI. Sounds like you just might be outside the statute of limitations or very close to it. If you can put them off until the SOL runs out on them then they won't be able to sue you anymore because you don't legally owe the debt anymore. You also need to visit my www.creditwrench.com/18questions.html web page and learn how to deal with their phone calls. Experience

I've been an active consumer advocate for more than 40 years and have helped hundreds of people win cases against debt collectors as well as helping them defeat demands for summary judgment lodged against them by banks, debt collectors and defeat mortgage foreclosures and keep their homes.

Education/Credentials
Paralegal courses for the most part.
I have been teaching people how to deal with judgments, mortgage foreclosures and other such problems both on and off the internet for many, many years. I am a Richard Cornforth information provider ever since 2000 and worked with many other organizations and causes since 1980. I was Oklahoma State Chairman for the nationwide drive to defeat the Constitutional Convention which was proposed by various factions within our federal government such as the Council of State Governments and the National Organization of State Governors who were working hard to organize a Constitutional Convention to be held in 1995 for the purpose of rewriting our American Constitution to be more acceptable to the United Nations. I worked with Senator Charles Duke of Colorado and Senator Don Rogers of California and many others across the nation to keep them from getting the number of delegate states required to lawfully hold a Con-Con and we were successful. I have worked with many other legislative issues in Oklahoma and have always been very successful.
