Question
I recently found this on the internet. Since many people don't have contracts with third party debt collectors, can this be used as a defense?


novation  ordinarily arises when a new individual assumes an obligation to pay that was incurred by the original party to the contract. It is distinguishable from the situation that occurs when another individual makes a guarantee that a debtor will pay what he or she owes to a creditor. In the case of a novation, the original debtor is totally released from the obligation, which is transferred to someone else. The nature of the transaction is dependent upon the agreement between the parties.

A novation also takes place when the original parties continue their obligation to one another, but a new agreement is substituted for the old one.

Where did you get all this stuff? Who said "many people don't have contracts with 3rd party debt collectors?" Of course "many people" don't have contracts with 3rd party debt collectors but those who don't also pay cash for everything and never go into debt for anything ever. Can this be used as a defense? No, and if you didn't have a contract then you don't have to worry about a debt collector or a defense.

How about the novation stuff? Where did that come from? Sounds to me like you probably have been sued and also have been listening to a bunch of junk arguments found all over the internet. Best you get down to business and leave that stuff alone.

I am a Richard Cornforth information provider ever since 2000 and worked with many other organizations and causes since 1980. I was Oklahoma State Chairman for the nationwide drive to defeat the Constitutional Convention which was proposed by various factions within our federal government such as the Council of State Governments and the National Organization of State Governors who were working hard to organize a Constitutional Convention to be held in 1995 for the purpose of rewriting our American Constitution to be more acceptable to the United Nations. I worked with Senator Charles Duke of Colorado and Senator Don Rogers of California and many others across the nation to keep them from getting the number of delegate states required to lawfully hold a Con-Con and we were successful. I have worked with many other legislative issues in Oklahoma and have always been very successful.
