Question
Daughter is 32 has been laid off several times the past two years and is behind in owing on credit cards.  Credit cards have been turned in over two years ago.  She is presently unemployed.  No funds coming in.  She has written and informed credit card companies that she is unemployed and has no funds to pay until she finds a job.  They keep calling everyday and now are threatening her with garnishment and law suit.  If she has not job and no funds what good is it going to do to go through this?  If she had the funds she would make at least a payment of some type to show her good faith. She is at her wits end and very disturbed.  She did not put herself in the position of being laided off several times.  Does she have any recourses to help her get back on her feet?  Thank you

Answer
Not that I know of. She could offer to settle the debt if she had some cash to make a lump sum payment.  If not, the credit card company will turn the account over to a collection agency and the collection efforts will increase.  I wish I had better news for you but I don't.

Expertise

I am qualified to answer questions on the following subjects: FDCPA, FCRA and HIPAA as well as medical collections, general collections and collection agency related issues. I trained these subjects at a nationwide collection agency and customer service call center and audited around 150 representatives for compliance to the laws. I have been in the Collections Industry for over 30 years. I feel that everyone deserves to be treated fairly and with compassion and that is the way I trained collectors. Even though I worked for a Collection Agency, I get great satisfaction in helping those who have been mistreated or in need of help with these confusing issues.

Experience

I was the Compliance Administrator with a nationwide collection agency and customer service call center-I have trained hundreds of collectors on the above referenced topics. I have been in the medical collections industry for over twenty years and research these topics on a daily basis.
