Question
Hello,

Thanks for providing this forum.  I was involved in an auto accident while travelling back in 2004 when I was seen in the emergency room.  All bills paid no problem.

Years later, I get notification from a collections agency for a bill for a date of service in 2007.  Living more than 2 hours away from the place of service, I am certain that the service was not performed for me.

They have produced an invoice from the MD with my correct information, however, I suspect that the service occured for someone with a similar name but was tied to my record.  I have talked with the collection agency and informed them of this information.  What other recourses do I have since I am 100% confident I was not seen at the facility on that date of service.

Appreciate any advice.
Mike

Answer
First of all, dispute the debt in writing with the collection agency.  Second, file a fraud case with your local police and as soon as you get the paper work back, file it with the credit reporting agencies as fraud.  They will have to remove it.  Make sure the collection agency gets a copy of all of this.  I hope you fine this helpful.

Expertise

I am qualified to answer questions on the following subjects: FDCPA, FCRA and HIPAA as well as medical collections, general collections and collection agency related issues. I trained these subjects at a nationwide collection agency and customer service call center and audited around 150 representatives for compliance to the laws. I have been in the Collections Industry for over 30 years. I feel that everyone deserves to be treated fairly and with compassion and that is the way I trained collectors. Even though I worked for a Collection Agency, I get great satisfaction in helping those who have been mistreated or in need of help with these confusing issues.

Experience

I was the Compliance Administrator with a nationwide collection agency and customer service call center-I have trained hundreds of collectors on the above referenced topics. I have been in the medical collections industry for over twenty years and research these topics on a daily basis.
