Question
I had a Comcast account back in Jan of 2010 which was closed Mar. 2010 and ended with them sending me a refund check of $96.87. I went to start up service with them again 10/19/11 and was told I have a balance $96.87 that was sent to collection April 2010, only 45 days after it was closed. I didn't receive any statements that i still had a balance with them, I wasn't given any notification of it being sent to collection. Is this against the law? They are saying the balance is from ppv charges and unreturned equipment but all of the equipment was returned at one location together and the refund check was sent after my account was sent to collection. It doesn't make sense to me.

Answer
It is not against any law that I know of except the laws of accounting.  Send them a certified letter explaining your case and ask them to send you an itemized accounting of this account showing all transactions.  Give them 30 days to respond in the letter and explain that if this is not resolved you will report this matter to the BBB, Consumer Affairs and the Attorney General of your state.  Also in your letter demand that this be removed from all credit reporting agencies if it has been reported.  If they do not respond to your letter within the time allowed be sure to follow through the terms of your letter and copy them with a copy of the letter sent to the above agencies.  Good luck with this.

Expertise

I am qualified to answer questions on the following subjects: FDCPA, FCRA and HIPAA as well as medical collections, general collections and collection agency related issues. I trained these subjects at a nationwide collection agency and customer service call center and audited around 150 representatives for compliance to the laws. I have been in the Collections Industry for over 30 years. I feel that everyone deserves to be treated fairly and with compassion and that is the way I trained collectors. Even though I worked for a Collection Agency, I get great satisfaction in helping those who have been mistreated or in need of help with these confusing issues.

Experience

I was the Compliance Administrator with a nationwide collection agency and customer service call center-I have trained hundreds of collectors on the above referenced topics. I have been in the medical collections industry for over twenty years and research these topics on a daily basis.
