Question
I purchased a car in 2006 with my ex husband..we divorced, I made the payments on the car until he took possession in August 2007. He stopped making payments and the car was repossessed..Fireside Bank has called me for payment..I've made monthly payments for the last year and half..I asked for a statement or a balanace on my account..the representative said he would send a statement then it never came..I called and then other representative said they sold my account to someone else and gave me their number and said to call them..I had the payments set up for automatic withdrawal but withdrew the money from my account since I never received a statemnent and Fireside tried to withdraw the payment eventhough they said they didn't have my account any longer...are they required to send me a statment or something stating the balance when I request one? should I continue to make payments? should I contact Fireside? they called after my payment was not received as scheduled..they also said they would only charge me half the balance and mark my account paid in full once half the balance was paid since the account was in both my name and my exhusbands..but  never got it in writing..I live in Salem, Oregon...what should I do?

thank you for you time

Deborah

Answer
Write them a letter demanding a statement of account.  If they do not send one, send them one more letter telling them that unless they do send it, you will report them to Consumer Affairs, the BBB and the Attorney General of your state.  I would also get a letter proving that once you have paid your half, they will take your name off of the account. Good luck with this.

Expertise

I am qualified to answer questions on the following subjects: FDCPA, FCRA and HIPAA as well as medical collections, general collections and collection agency related issues. I trained these subjects at a nationwide collection agency and customer service call center and audited around 150 representatives for compliance to the laws. I have been in the Collections Industry for over 30 years. I feel that everyone deserves to be treated fairly and with compassion and that is the way I trained collectors. Even though I worked for a Collection Agency, I get great satisfaction in helping those who have been mistreated or in need of help with these confusing issues.

Experience

I was the Compliance Administrator with a nationwide collection agency and customer service call center-I have trained hundreds of collectors on the above referenced topics. I have been in the medical collections industry for over twenty years and research these topics on a daily basis.
