Question
QUESTION: I have a small sewing business out of my home.  I sew
and sell mail straps to mail carriers, employed by USPS.
A rural carrier in Windsor, N.C. owes me $85.  She bought
mail straps and carries the U.S. mail with them and won't
pay for them.  I told her to return the straps and she won't
do that either.
Can I do garnishment?  How do I do that?
I made phone calls and sent many letters, to no avail.

         Thanks,     Dick

ANSWER: Before you can do anything, you will have to take her to court and get a judgement.  North Carolina not being a garnishment state there is not much you can do.  You can refer the account to a collection agency and ask them to place it on her national credit bureau file.  I wish I had better new for you.

QUESTION: Thanks for the answer.  She uses these straps at her work to
deliver the mail.  (It's odd she is witholding payment)
I have her work phone number.   Can I get in big trouble calling
her at work. The straps are a work related item.  I think she is trying
to rip me off.  It's $85.   We are a very small company so would
appreciate getting paid.  This is my retirement income.

Answer
Calling someone at work is risky.  Since you are a first party collector you can call at work but release as little information as possible.  For instance.  Ask to speak to her about the straps she purchased from you.  Do NOT mention that she owes for them.  Who knows, it may get you some business.

Merry Christmas!

Expertise

I am qualified to answer questions on the following subjects: FDCPA, FCRA and HIPAA as well as medical collections, general collections and collection agency related issues. I trained these subjects at a nationwide collection agency and customer service call center and audited around 150 representatives for compliance to the laws. I have been in the Collections Industry for over 30 years. I feel that everyone deserves to be treated fairly and with compassion and that is the way I trained collectors. Even though I worked for a Collection Agency, I get great satisfaction in helping those who have been mistreated or in need of help with these confusing issues.

Experience

I was the Compliance Administrator with a nationwide collection agency and customer service call center-I have trained hundreds of collectors on the above referenced topics. I have been in the medical collections industry for over twenty years and research these topics on a daily basis.
