Collections Law/Phone Calls

Question
I am a cosigner on a second mortgage and my ex is late on the payments frequently. I have repeatedly asked them not to call me and tell them that I no longer speak to him and that he will make they payment when he can. They call 3-4 times a day, even after I answer the first call. Is there anything I can do about the repeated phone calls one right after another? Today they called 3 times within 3 minutes. Is this even legal?

Answer
As cosigner, you can expect calls when the loan is past due. They are also attempting to collect the payments from you.  Should your ex stop making these payments, they will legally look to you for the payments. You can also expect this to affect your credit history if it affects his.

Now to the calls.  They should only speak with you once each day.  I would let them know that you would be willing to report them to the BBB, Consumer Affairs and the Attorney General's Office if these calls did not cease.

Expertise

I am qualified to answer questions on the following subjects: FDCPA, FCRA and HIPAA as well as medical collections, general collections and collection agency related issues. I trained these subjects at a nationwide collection agency and customer service call center and audited around 150 representatives for compliance to the laws. I have been in the Collections Industry for over 30 years. I feel that everyone deserves to be treated fairly and with compassion and that is the way I trained collectors. Even though I worked for a Collection Agency, I get great satisfaction in helping those who have been mistreated or in need of help with these confusing issues.

Experience

I was the Compliance Administrator with a nationwide collection agency and customer service call center-I have trained hundreds of collectors on the above referenced topics. I have been in the medical collections industry for over twenty years and research these topics on a daily basis.
