Question
Hello,
My Grandmother and my girlfriends Mom both received a message on their answering machine yesterday saying that they were calling investigating me (they gave my name) for check fraud. They left what they called a case # and said that they were going to file something in the courts next week and that if they new who I was to give me the message and have me call them back if I wanted to settle out of court.
Now my girlfriends Mom is all in a rant thinking that it is indeed check fraud and doesn't believe when I say it was a pay day loan. Pretty much believing what the women has said.  Now I did take out a couple of pay day loans a couple of years ago and after I called I pretended to be my brother and they said that it was for a pay day loan and that the original creditor was suing me.  Now after researching I have found out that they have broke several laws under the Fair Debt Collections Practices act.  Ruining my reputation saying things that are false and contacting people that have no need to be contacted and giving them false information etc.  What do you Think?

Answer
Since they are first party, they are not covered under the FDCPA.  They should not have given out your information but that is how these guys collect.

Now some free advice, stay away from these people, they are nothing but trouble.  Good luck with this.

Expertise

I am qualified to answer questions on the following subjects: FDCPA, FCRA and HIPAA as well as medical collections, general collections and collection agency related issues. I trained these subjects at a nationwide collection agency and customer service call center and audited around 150 representatives for compliance to the laws. I have been in the Collections Industry for over 30 years. I feel that everyone deserves to be treated fairly and with compassion and that is the way I trained collectors. Even though I worked for a Collection Agency, I get great satisfaction in helping those who have been mistreated or in need of help with these confusing issues.

Experience

I was the Compliance Administrator with a nationwide collection agency and customer service call center-I have trained hundreds of collectors on the above referenced topics. I have been in the medical collections industry for over twenty years and research these topics on a daily basis.
