This summons his rather confusing it states the following:

If you have been named a defendant in a complaint filed at the municipal court by:
Asset acceptance LLC
There address
You are hereby summoned in required to serve up on the plaintiff’s attorney. Or the plaintiff, if he has no Attorney of record, a copy of the answer to the complainant within 28 days after service of the summons up on you, exclusive of the day of service. Your answer must be filed with the court within three days after the service of your answer on the plaintiff’s attorney.
If you fail to appear and defend, judgment by default me being rendered against you for the relief demanded in the complaint
Here is what the complaint lists:
Comes the plane of, by counsel, and for its cause of action against the defendant states as follows:
1. The defendant is indebted to the plane of under the agreement or account evidenced by the exhibits as attached and incorporated hereto as exhibit “a”
2. Asset acceptance LLC purchased this account. The original credit grantor is referenced on the exhibit attached hereto.

Defendant has failed to pay the plane of the remaining balance of its account and the sum of $781.45, plus accrued interest in the amount of $1164.84, together with interest at the annual rate of 18% from July 10, 2007 until the day of judgment and then at 8% per the annum on all and judgment until satisfied., Court costs and any other relief to which it made up here entitled.

End of summons.
First of all what should be my first course of action?
I was not aware of this debt until about five months ago when I was visiting with my mother and they had called on her cell phone!
I had told them I didn’t know what debt they were talking about it must’ve been something from my divorce that possibly my ex wife had gotten and I had no idea about my divorce was finalized in 1999.
I had asked where is the debt from she would not tell me.
The lady kept me on the phone and she kept asking me questions, I told her that I’m not going to pay I do not know what it is I don’t see it on my credit report please stop calling me and sending me letters. She continued to push me for information as to about she had noticed I had changed my employment type. I just changed job occupations because it was noted on my credit report that my status was changed from a very old employer to a subcontractor. I told her yes that is true but that is not of your business and again I do not plan on paying this do not call me anymore I then hung up.
She called back right away I said look lady you have no business calling this phone and how did you get my mother’s cell number anyway she would not answer that question. I told her I am not going to pay and I can’t pay I live at home with my parents and help take care of my mother and their home when they are in Florida. She goes on to ask me about this subcontractor job I tell her it’s none of her business again but still she keeps pressing me to make an agreement to pay telling me to borrow money from my parents, go get a loan from my bank.
I tell her again I am not going to do that and it is none of your business.
She goes on to belittle me say how proud my parents must be of their son not able to afford an 100 dollar month payment. Finally she did tell me where the debt had come from and she said Elder Beerman, I said in reply lady that account was 10 years old and in default in 1998 and that the statute of limitations is up on it anyways please stop calling good bye.
She called back 5 times after that I would just open the phone and close it.
They still call my mother cell phone and my home phone about 2-5 times a month.
And I would get a letter from them about once a week demanding payment.
I never agree to anything over the phone or in a written contract nor did I make any type of payment whatsoever.
Then I receive this summons in the mail that I had to sign for today.
So I go and check my credit report online and I do not even see this or any department store card or this company that has filed suit even listed on my credit report.
So why then begin to look on the Internet for statute of limitations in the state of Ohio.
All I could find income to the conclusion of that this is an open ended account.
And according to what I have read the state of Ohio statutes of limitations §2305.07 on open ended accounts of six years.
That the statute of limitations does not cause you get to go away after to expires if the credit are file suit the consumer has an absolute defense that consumer must offer the new evidence to lee Boyd a judgment the evidence will consist of papers the consumer files to support this claim if the credit are sues you and you do not prove to the court that the statue of limitations expired you’ll have lost lawsuit in a judgment against you.
Is this true?
If it is true then the latest they could have filed suit and won according to what the web site says is March 23 2005.
And what paperwork is that referring to and what do I need to do with it?
Any advice would be greatly appreciated to help me clear this matter up.

The bottom line is that you are being sued by Asset Acceptance for the Elder Beerman Account.
I have dealt with these guys before and they do not play by the rules. I would bet that there is not even a case number on the "Court Filing"
So, based on the fact that you are dealing with these guys, I want you to go to my site mycollector.com and listen to some of the calls. If you are dealing with an Out of Statute Case, this will be a slam dunk.
No matter what, do not "not appear" . You need to DEMAND all of the MEDIA to support the debt. INCLUDING the ORIGINAL SIGNED APPLICATION, ALL SIGNED BILLING CHARGES and ALL STATEMENTS. The "Affidavit" that they use that is signed by the original creditor, is bullshit.
