Question Dear Robert,
I'm a 67 year old lady on social security which is my only income. Resently I was served with papers to appear in court with two Capital One collection agencies. The paper plainly stated that if I wished to dispute the charges I was told I owed on these cards I would need an lawyer. I could not afford one so I didn't go to court. They have been awarded judgements against me, I assume. After this I started getting calls from them, one in particular...This call is for Vida Harrill, if you listen to this call I will assume you are Vida Harrill....Ok you have listened to my call so now......IT was my answering Machine!!!!! And there have been many others like asking for a man I divorced in 1983!
Well anyway, now I have received a letter from their collectors saying that they are sending out a sheriff to serve papers demanding me appear in court and bring all my bills and bank statements to prove I can not pay them.
I have been told they can not bother my bank account but can they get the authorization from the courts to drag me into a situation that I would have to prove my inability to pay them? The original bills were $350 and $500 which by now are $1300 and $1700. I defaulted on these bills because I paid minimum payments, all I could afford and when I sent them in I was always charged a late fee because my SS check wasn't deposited yet. Finally because my credit is non existent anyway I stopped paying them.
Please advise, I'm going nuts!

Answer Hello And thank you for writing me maam,
I am honored that you chose me to ask this most serious question to regarding the Big Bad Wolf, Capital One.
So, lets look at your situation.
The papers that you were served with were called complaints. This is how a creditor goes about suing somebody if they want their case to appear in court.
In the paperwork, it said that you had only a certain amount of time to reply to those crazy papers that are so hard to understand. But, they do not allow you not to respond because you can not understand them or feel that you need a lawyer.
So, now they have what is called a default judgment against you. That is ok because your only source of income is social security. This is kind of like having a plane ticket, but there is no plane, it is worthless.
Now, the message that you received on your machine would scare anyone.
What is happening now hon, is that you are being asked to go back to the court and PROVE that all you have is Social Security. Do not be scared. This is only what is called a Supp Order.
So, here is the big question.... who is this collection agency. I want you to send me an email and tell me the name and address of the attorney firm and the collection agency.
Once you do this, I want you to send me your phone number and we will do an inteview. Do not worry, only 1,000,000 people will hear it Vida!

Charge to you.... ABSOLUTELY NOTHING....If they did this to my mom or grandmother I, along with most americans would be outraged.
