Hello Sir,
Recently I was reading about credit disputes on the About.com website. You seem pretty knowledgeable so I will direct my question to you. When I was 16 or 17 I got a cellphone from Cingular Wireless. I lied about my birthday on the contract because you're supposed to be 18. I was never asked for I.D. so the age wasn't an issue. I had the phone for 2 months before it was turned off. My question Is, can I dispute the charges because I was not old enough at the time to enter into a legally binding contract? Could I at the very least dispute the 150.00 early termination fee that was attached to the contract? I check my credit report yesterday and the have two entries for the same bill. One says the amount is $388.00 and the other says $377 can they make two entries on my credit report from one item? I eagarly await your response. If unable to reply due to me not being a client, could you possibly direct me to a lawyer in the Kansas city, MO. area I could speak with.

I want to take a moment to thank you for taking the time to write to me today about your situation. For our readers, I want to say that Brandon contacted me privately yesterday and I read his e-mail and sent him a special reply asking him to post his question to this forum so that all of you who find yourself in the same situation may be able to learn from this information.
In your letter Brandon, you state that at the time that you ordered the Cingular Wireless phone that you were only 16 or 17. That is the bottom line and that is how the courts will look at this (which it will never get that far)
Under our laws, it is impossible for a person who is under the age of 18 "which has been established as the age of accountability" to enter into any type of binding financial agreement.
My company, Western Capital, located at www.mycollector.com has collected on cell phone accounts for years, and whenever this situation occurs, all that we do is ask you to send in a copy of your drivers license and/or birth certificate.
If indeed we confirm that you were a minor at the date that the contract was signed REGARDLESS OF HOW IT HAPPENED, we then refer the case back to ATT, CINGULAR or VERIZON and that is the end of the collection activity on that account. Neither the phone company nor the collectoin agency is permitted under the FCRA (Fair Credit Reporting Act) to report the account, or you will be entitled to damages up to $10,000.00
Now, Brandon, I want you to take a copy of this letter, a copy of your drivers license, a copy of your birth certificate and I want you to send it to Cingular Wireless at the following address:

You need to send the COPIES of the collection letter and the documents that I have asked you to submit to Mr. Tew's office. I also want you to fax me a copy of everything that you send to them.
My personal belief is that upon reading this letter and the associated documents that you provide, that the Cingular office of General Counsel will immediately instruct the agency management group to pull your account from the collection agency and to delete any and all references to the account.
