I owe $2500 in credit card payments I have been unable to make because of a recent long period of unemployment I have sent $100 in the last year and a half since it was sent to collection the first 3 months I got notices in the mail but after that people were calling and hanging up so even though I am not positive it was the agency I suspect it was,Now they have given it over to an attorney and I have 30 days as of the 23rd I recieved a letter to either pay the amount or dispute the charges,What should I do?,$100O is all that I can pay plus I admit I get bad tempers and have a disability and I ignored and hung up on several of the calls.Can they take me to court if I attempt to make some payment? I live in Virginia the attoeneys are based out of Atlanta,I want to repair my bad credit history but it is sad when you are out of work and can't make payments,not that bill collectors care.I realize I screwed up and I won't use a credit card ever again if I don't need to,of course I can't get one right now.Should I get a lawyer who specializes in this before I even reply to these people? Any advice.

First of all, thank you for taking the time to write to me. I am glad that you are looking at all of your options regarding your issue.
My advice is that you:
1. Call the company that keeps sending you the letters and tell them to quit calling you.
2. Fax them a letter confirming that you can only pay 25.00 per month on the account. In that letter, enclose a check for the 25.00 for the first payment. In the memo section of your check, write that this is a payment on account XXXXXX.
3. After you send the check to the Collection Agency, Call the attorney in the other city and tell them that you are making payments and fax them a copy of the letter and a copy of the check. This will most likely resolve the lawsuit issue.
Just understand that most of the time, the Collection Agency has no benefit in suing you. As long as you are making the payments on a regular basis, you should be ok.
One final bit of advice, please document everything that you do on this matter. Get the persons name and their phone number. Keep this data so that in case the matter is going forward, then you will be prepared. Just follow the steps as I have outlined!

Thanks,so the issue here is as long as I am making some attempt to make payment,which obviously I haven't,they won't pursue this legally.If I pay only $25 it would take 10 years to pay this off,I know people make excuses to cover thier mistakes but honestly these were car repair charges and moving expenses because I moved from Tucson here to Wash DC in 2001 for greater job opportunity,anyway that is in the past but my main concern here is my credit history and how badly I damaged it.

You are correct in your assumption that as long as you are making SOME SORT of payment, that the agency will generally not sue you.
I would still send them a letter with a MONEYORDER for the 25.00 each month. On the memo section of the moneyorder put the words PAYMENT ARRANGEMENT ACCOUNT XXXXXX.
This will clearly establish your intent to pay!
