Hello:

I want to sue a company based in OH for $15,000 due to me. I live in GA (Paulding County). Can I file in my county Magistrate court, or do I need to file in the county/city where the defendant is headquartered/located?

Michael:

    No, you don't have to institute a civil action against the defendant where they reside however, you would need to check the juridictional limitations of your Magistrate and Circuit/District Court.  My inclination is that $15,000.00 may exceed the threshold of your small claims court and thus, you will need to file your Complaint in a higher court.  Also, ensure that you have some basis for jurisdiction in GA; i.e., breach, tortious conduct, defendant does business there, etc.
