Question
TODAY I RECEIVED A CALL FROM SOMEONE STATING HE WAS FROM THE ABOVE OFFICE AND THEY WERE GOING TO SUE MY HUSBAND REGARDING A CAPITAL ONE ACCOUNT. ABOUT A MONTH AGO WE HAD ANOTHER LAW FIRM STATE THE SAME THING SENT A SETTLEMENT LETTER AND NEVER DID THEY RESPOND. NOW THIS  WHEN I RECALLED THE NUMBER I FOUND THEY WERE A BOTTOM FEEDER DO I WAIT FOR MORE NOTICE:

Answer
If you receive notice of a debt you should dispute the validity of that debt under the Fair Debt Collection Practices Act. This is federal law. If they cannot verify the debt you shouldn't hear from them again. If the do verify it you should send a cease and desist contact letter by certified mail. Once received they cannot continue to call.

Check the statute of limitations law for your state and don't panic, things aren't always as bad as they seem.If you receive a summons you have the right to defend yourself. Make sure if you do talk to them by phone you record the conversation (if legal in your state). If you catch them violating the fair debt collection practices act file a complaint with the Federal Trade Commission and your state Attorney General
