Question Hi Robert, I just received a summons from a local attorney representing CACV of Colorado for debt they purchased from Chase a couple years ago. Mind you, before the card ever went into collections, I attempted to put Chase along with the rest of my debt into a debt counseling program. I successfully completed the program and paid off all my debt, but after accepting 3 payments, Chase dropped out and sold the debt. When contacted by CACV of Colorado/JA Cambece I set up payment arrangements with them and made 17 payments total $672! They offered a settlement and I promised when I got my taxes I would call them back on it. In the meantime, I'm still making regular "draft" payments. When I got my taxes I called them to settle the account - they said they would have to check with their client, then came back on the phone and said their "client" declined to settle, but if I had $800 to send it all to them or be dropped from my pmt arrangement. Now I looked at how much I had been paying and noted that the balance was the same $2300 that it was when I started. At that point I gave up and told them I wasn't paying another dime without a settlement and would not authorize any more drafts from my checking account. They got mad, called for a while and now comes the summons to which I have no idea how to respond. The balance now is $2800! Help!

Thank you for taking the time to write to me about CACV Collections in Colorado.
Here is what I see.
Chase made a workout agreement with you to repay this debt. You agreed to the payment plan and made 3 payments as agreed.
This is why I am NOT a supporter of CCCS or any type of Consumer Credit Counseling Service. It simply does not work and more than likely, it will hurt more than help.
If anyone has a disagreement with this, I would love you to present your argument and I will publish it on our International Site at www.mycollector.com
So, back to the issue at hand. The creditor dropped out of the payment plan with the credit company because they found that it is much easier to sell off the debt to the secondary market in bulk rather than spend the time and money dealing with a third party.
So you receive a call out of thin air and you are told that they now have your account and that the payment arrangement is not valid anymore. So they want to quickly cream the account and they demand a settlement, and you jointly come up with a figure of 800.00 .
Now, as a collector, they are thinking, if you can come up with the 800.00, then you can come up with the full balance.
So they blame the error on the "CLIENT" , which is what JA Cambece does. There is no damn client. They own the debt!
So now some secretary sends you what looks like a summons to appear in court hoping that you will call and plead to make a higher payment to avoid going to court.
So here is what I would do. JA Cambece is morally bankrupt. I have dealt with them in the past and they are constantly on our site searching for their name, we for google here it is. JA CAMBECE LAW FIRM IS A SCAM!
I want you to call the court and see if there is a case number on the filing that you received. If there is no case number, I want you to let me know immediately.
Next, I want you to send in an answer to the court. DO NOT EVER MISS A COURT DEADLINE. IF YOU HAVE 20 DAYS TO ANSWER, then answer. do not mess this up, because this is how collection agencies make tons of money.
Next, I want you to state in your answer to the court that you have requested VAIDATION OF THE DEBT and they have not provided it to you.
In other words you want PROOF that the debt is due, that JA Cambece owns the debt AND has the right to sue FOR CHASE and that every single charge has your signature to confirm the balance. Oh, you also want to demand a full copy of the ORIGINAL SIGNED APPLICATION. This is all called THE MEDIA.
I GUARANTEE that Chase can not provide all this by the dates imposed by the court.
So, take them to the mat, and do not fall for this bullshit.
