HELLO , About 2-3 years ago I was in a DUI accident! I hit my rental car into the rear wheel of a parked semi truck . The rental company charged me on that which I am currently paying for off of the credit card I used but now I just started receiving phone calls from a collection agency from which I believe is atempting to collect on behalf of the semi truck's insurance claim .When I was in criminal court neither party came after me nor showed up to the punitive damages side and that case ended with the no contest plea etc. but no award to either side. So now this collector has sent their first letter saying I owe them about $8200. I dont think that much damage was done and I dont want to admit or even acknowledge the debt, it may be unfair because they never even contacted me about it or what the damage actually was!My question is how should I approach this matter and what is the smartest way for this issue to be resolved without some kind of garnish of wage or strike against my credit report? Because I have no way of paying for it .

Hello Mr Mac. I appreciate the opportunity that you have provided me to answer your question.

Ok. I understand that you were in a DUI Accident a few years ago.  I also see that you paid for the rental car with a credit card. (I would always suggest using a DEBIT CARD) for renting cars for obvious reasons.

Now you are being chased by a collection agency for the amount that was paid out on the claim. This process is called subrogation in the world of insurance.

So now, 3 years later, they are deciding that you owe 8200.00 for the accident.

Well, here is my advice.

1.  Demand that they provide validation of the debt in writing.  That means that they are required to provide you with each and every amount that they are attempting to collect on, and they MUST do this in a 30 day validation period.

2. Second, I want you to visit our friend Bud Hibbs site at www.BudHibbs.com and scroll down to the bottom of the page and download his CEASE COM letter.  Fill this out and send it certified.

3.  Do not talk to the collectors that call you unless the call is recorded.  Check our site at www.CollectionIndustryLive.com and scroll down until you see the link.. CAN I RECORD. This varies from State To State.

4. Do not EVER AGREE to send a partial payment on the account. This will reset the date of last activity and is NOT in your best interest.
