QUESTION: Hello - On 12/20/06 my 24 year old son was struck by a car while walking across the street in Portland, Oregon. The paramedics took him to the hospital where he incurred roughly $20,000 in debt and may need a total hip replacement down the road. Medical bills have been coming in right and left and he has maintained contact with his medical insurance company, United Health Care, who sat on his bills until the hospital finally sent them to collections this past August. Two weeks after they were sent to collections, UHC decided they would pay their portion, believed to be 80%. Every time my son would call UHC he got a different answer as to why they would not pay. He kept telling them the truth...The girl that struck him was on her cell phone and wasn't paying attention. When the police arrived, she gave him false information  and she is no where to be found. She may have been under the influence...who knows? The policeman simply wrote his report while eating his Dunkin Doughnut and left. We have called a couple attorneys and both said not to pay the medical bills and then eventually advised my son they can't help unless he has a reliable witness. The policeman acted like I was the criminal and brushed me off. So my son is faced with $2500 in debt ($900 is from one month interest) and the collection agency is telling him they want all money by next month or they will contact the credit bureau. He has asked if they will accept a payment plan and they flat out said no. He works in retail and is unable to pay this in 30 days. He wants to put it on his credit card and I told him that's not a good idea. He's sick to his stomach and is very stressed out because of  this and is worried about his credit and has no one to turn to for legal advice. He told the collection agency he would pay the debt minus the interest but they said they want it all. This is utterly ridiculous...Here he was struck by a jibber jabber, smashed into her windshield and lay in the middle of the road not knowing he would make it through the night. He has several months of long recovery and was led to believe his insurance company whom he pays premiums every month would cover his expenses. They sat on it for months because the accident involved an automobile and they wanted her insurance company to pay so then because of that, it was sent to collections. We simply don't know what to do at this point...and who knows, he may still need further medical attention because of this. any advice would be greatly appreciated. Thank you

ANSWER: Katrina,

This is the kind of shit that keeps me doing this type of work for free.  This is completely crazy that they sent him to a collection agency.

Do me a favor and call them and tell them that you are workig with me, fax them a copy of this letter and tell them to follow the charity guidelines.

This is what congress was absolutely discusted with last term.

If they refuse, send me the name of the hospital, everyones names and the collection agency and their actions.  I also need you to write me a letter outlining what happened so that our international readers can easily understand it.

If they get this letter and still hold him to the balance and do not pull the account from the collection agency, we will file a complaint with the AMA, the Rip off Report, the medical licensing board, the bond company for the collection agency, and we will assemble a group that they have done this to in the past and create a class action lawsuit.

To the hospital: Do you think we are joking? Try turning this kid down under your charity obligation.

Nonprofit hospitals routinely overcharge or deny care to patients least able to pay, Senate investigators have found, raising questions about whether the institutions should be eligible for tax exemptions that cost the U.S. Treasury billions of dollars a year.

Many of the hospitals that say they offer charity care -- meaning free or at reduced prices for low-income people -- fail to inform patients about such assistance, Senate Finance Committee staff members found after a 15-month review that included an in-depth survey of 10 nonprofit hospitals.

The investigators found that while federal law requires charity care in exchange for tax-exempt status, a 37-year-old IRS rule implementing the law is so vague that nonprofit hospitals have been able to exploit it by offering some free services but often little aid to the poorest people in their communities.

Nonprofits frequently charged higher prices to poorer people with no health insurance than they did to better-off patients who had coverage, researchers found. At the same time, many of the hospitals' top executives enjoyed generous perks such as paid country club memberships and stays at expensive hotels.

"Non-profit doesn't necessarily mean pro-poor patient," Finance Committee Chairman Charles E. Grassley (R-Iowa) said in a statement yesterday. The committee plans to focus on the findings today in a hearing examining whether nonprofit hospitals provide sufficient community benefits, including charity care, to justify their exemptions from federal tax and from most state and local taxes.

The hearings also will focus on the lack of standards for community and charity care, and inconsistent reporting requirements, which Grassley says makes it impossible to accurately measure if nonprofit hospitals are fulfilling their obligations. Some hospitals say they fulfill their obligations by offering free eye and breast exams. Others count bad debts as charity care.

The Senate staff members found that some for-profit hospitals provided "as much if not more charity care than some non-profit hospitals," Grassley said.

More than 3,000 of the nation's approximately 4,900 hospitals are nonprofit; the rest are either state-run or for-profit.

In addition to surveying 10 hospitals, Finance Committee staffers looked at cases of alleged abuse from around the country, talked to community groups and reviewed studies by health-care economists.

"We believe that America's hospitals do more than virtually any other segment of society in serving the health care needs of those who have no coverage," Rick Pollack of the American Hospital Association, which represents both nonprofit and for-profit hospitals, said in response to the Finance Committee's findings.

"Beyond providing free care to those in need, and financial assistance to low-income people without insurance, hospitals also provide a broad array of other community benefits ranging from health screenings, child immunization, poison control, trauma care, health professional training and research," he said.

One witness scheduled today is Diane Insco, 54, of Cincinnati, who suffers from Type 2 diabetes. She is to recount how she nearly lost her home after a hospital put a lien on her house for failing to pay a bill for $4,639 for a two-night stay. She later learned that her $14,000 income for the year qualified her for charity care, which she applied for and won. The hospital then canceled the debt and lifted the lien.

"If I qualified for charity care, why didn't they tell me in the first place?" she said in an interview yesterday. "No one at the hospital ever mentioned that to me."

Several state attorneys general, including those in Illinois, Kansas and Minnesota, are looking into possible abuses by tax-exempt hospitals. In the past two years, lawyers for the poor have filed federal lawsuits in at least 22 states accusing nonprofit hospitals of failing to meet their tax-exempt obligations to provide indigent care.

Thank you for responding to my letter about my son, Dylan. He contacted the collection agency today and advised them he is working with you and that they should follow the charity guidelines. I also sent them a copy of my letter to you and your response to my letter. Both the hospital staff and the collection agency told him today everything is "out of our hands" and there is nothing they can do. They both just brushed him off. What is next?

A few questions:


I'm not quite clear what you need from the hospital when you say to get "everyones names, collection agency and their actions". I'm sure my son has a letter from the collection agency. Should he fax that to you and to what address?
Are they familiar with your professional history?  
What other letter do you need from us for your international readers?
Are your services free of cost to Dylan?
Do you take phone calls - can Dylan call you or do you prefer contact by email?
Will you actually be representing my son?

Please know Dylan and I are very thankful you are available to guide and help us through this, however, he is skeptical and does not quite believe me when I say you will help him. He thinks it could drag on for another year and really has no energy left to fight these people. He wants to put it all on his credit card to have it done with so he doesn't have to worry anymore. Great to hear from you again. Sorry for the delay in getting back, but I was traveling doing a seminar!

What is happening here is that the collection agency is saying that this matter is out of their hands as a way of telling your son to go to hell.  They at the hospital will say the same.  That is the game that they play.

Now, When I asked you to provide me with the name of the hospital and the names of everyone involved, I did so because I am planning on writing a story on Dylan's case.

I also need a VERY DETAILED letter outlining exactly what has happened in this situation, who did you talk to.  who did you write, that kind of information.

I am not going to charge him a dime. This is a complete abuse of the charity requirement and all that they need to do is go to www.mycollector.com and that will clear up the issue of who we are.

Understand, we CAN NOT "Represent" your son like an attorney. If you want that there are no shortage of guys who will take 5K to fight this.
