Question I got several payday loans and was paying them thru my checking account until one of the payday company sent in for full payment. At that time my checking account when into overdraft and things got bad because my whole pay check was being eaten up in overdrafts. I talk with one of the representative at the bank and then I just close out my account to keep matter from getting worst. I haven't had any of the payday creditor call me as of yet. But I have email all of the ones that I have email addresses for and allow them to know that I have overdraft in my account and probably will close so that I can stop the overdrafts. This situation has made it very hard for me to make my rent and utility payment at this point. I do desire to pay these loans back but I have no address to sent them the money and I did ask for address when I wrote them but none but one has replied. I guess I'm afraid that living in Florida and not know what the laws surrounding this kind of situation would pose for me. I do want to do the right thing. Can give me maybe a course of direction. After reading some of your other responses I thought maybe you can help to take the worry away or fear that I might have of going to jail and how to deal with them when they do can. First of all, you got screwed by the payday loan company because they deposited the entire amount that was due outside of the agreement period.
Next, you have to look at your intent. Was it your INTENT to defraud this company? NO! Your account was open and they drafted payments from the account in the past, so that removes the criminal element of writing a check on a closed account.
Look, YOU HAVE AN OBLIGATION TO YOU AND YOUR FAMILY. These guys are trying to get paid on a 32 percent loan and they do not even take the time to write back... what a worthless organization.
Send them a copy of this letter and let them know the we advise them to close the account. If they do this you will not go after them.... It really is that simple.
