Hello, I'm glad I came across this site. I really hope you are able to give us some insight on collecting money for a transaction gone strangely weird on eBay.

My husband and I bought a digital camera on eBay well over a month ago worth just over $1k and have never received it. After several e-mails and phone calls, the seller said that as a favor, she let a friend use the account for this transaction and gave him the $$ to help him out in his "drop-off" service, none of which was ever disclosed on the sale. Now she claims her friend misused her account and now won't return her calls but that it's not his fault either--it is the company he represents who has the $$ and the product.

Everything seems so fishy and with many excuses, but she has been replying our e-mails and answering our phone calls and has even contacted her local police department, which we have some proof of. She claims she has given everyone an ultimatum but that she does not have the money to pay us back, appealing to her Social Security income and other personal issues.

In case this unfortunate event were true for her, we feel terrible about it; however, we don't believe it is any of our business this lady made such poor decisions and that we are now out that much $$ and are not able to deliver our professional photography services for a wedding this coming weekend.

We really don't know what to do. We believe this issue is in between she and her friend, but that she needs to take responsibility for the issue in between us. What can we do? Can a collections agency help us?

Thank you for writing to me on this sticky situation that you seem to have walked into.

The bis issue here is that you have obviously been victimized by an on line predator that is using EBay as their method of stealing your money.

The first thing that I want you to do is to cut and paste this message into a message that is directed toward the seller, so that they know what you are doing.

Next, we want to file a complaint with Ebay.  Go to www.ebay.com and login to your account and then follow the directions for filing a complaint.

If you paid via Pay Pal, do the exact same thing with Pay Pal.  They will open an investigation for you.

Next we will call the LOCAL POLICE DEPARTMENT in the city where the shipper is located and file a theft report.

Next, we will contact the FBI and the FBI Internet Fraud Complaint Center.  The Internet Fraud Complaint Center (IFCC) is a partnership between the Federal Bureau of Investigation (FBI) and the National White Collar Crime Center (NW3C).

IFCC's mission is to address fraud committed over the Internet. For victims of Internet fraud, IFCC provides a convenient and easy-to-use reporting mechanism that alerts authorities of a suspected criminal or civil violation. For law enforcement and regulatory agencies at all levels, IFCC offers a central repository for complaints related to Internet fraud, works to quantify fraud patterns, and provides timely statistical data of current fraud trends.

Liz, I am sure that if you follow these steps that you will be successful in getting your money back.  Do not listen to the excuses.  Give them 24 hours to WIRE your money back to you or start this process, and I can assure you that this is certainly not something that these scammers want to have to deal with.

Prison time or Paying you the Thousand Dollars?  That is their choice.
