Expert: Robert Paisola Date: 10/29/2007 Subject: Single mom gets Fake Summons- Robert Paisola is Pissed
Question About 3 weeks ago I recieved a letter in the mail from a New York law firm. The letter is reads "The law requires that we serve a duplicate of the summons, previously served upon you, as additional notice. You can avoid the entry of judgement by contacting our office....." The letter is dated 9/21/07. Attached to the letter is a copy of a summons stamped by the county clerk dated August 22. This is the first time I am seeing this summons. I called the Law firm to see what I was suppose to do...I don't understand any of this. I spoke to a man who said I need to make payments inorder to avoid a judgement. I asked him how much I needed to send each month and he said, "if you ask me, I will tell you the entire amount of $1946.00." The original amount I owed was around $800! The summons says $1446.82. The man at the law firm told me the rest was filing fees and interest. I told him I cannot pay this amount in full and that the most I would be able to pay is $100 per month (and that would be a struggle). A few days later, a woman from the same law firm called my home and asked how I was going to pay the debt...she had no knowledge that I spoke to someone a few days earlier at that firm. I asked her if I could pay $100.00 per month and she said that would be ok but only for 2 months and then she needed the balance in full! I told her there is no way I can do that. I am a single mom of three and have not recieved child support for almost a year and I am struggling to pay my bills. The woman said I needed to send a payment before Oct. 26. I was not sure if I should send this payment since the woman said I would have to pay in full by December?!? That same day, the woman called my job and asked my coworker about my work hours and if I was part time or full time etc!!! This entire thing is making me sick. Can the just freeze my bank account??? I will be homeless if I can't pay my landlord the rent. My paychecks are direct deposit. Please advise me on what to do.

First of all, please forgive the delay for getting back to you. I am getting hundreds of emails a day, and sometimes I get overwhelmed at the bullshit that is going on in this industry.
Here is the deal.
If the collection agency sent your case to a local court there HAS TO BE A FILING NUMBER on the paper.
If they file the papers and you are served with a proper notice of the suit, then there is NO REASON to call you.
Something is NOT RIGHT HERE. I must see a copy of the documents that they sent to you. Please immediately fax them to me at 408-889-2415 . I also need to know the name of the original creditor and the collection.
All that I will say is god help them if they are sending out bogus summons letters.
We will broadcast that to the world and they will be immediately closed down.
Finally, remember my number one rule.... RECORD ALL CALLS WITH COLLECTION AGENCIES...NO EXCEPTIONS and NEVER PAY THE AGENCY DIRECT, ONLY PAY THE ORIGINAL CREDITOR WITH A MONEY ORDER- NEVER A CHECK OR CREDIT CARD...
