Question
I just got a phone call from a collection agency/Law Office asking for my 26 year old daughter who moved from here in Mass to NH in 9/98.  This agency (from NY) has called several times before (even though I have asked them to stop calling) but this time the collector divulged that he was calling about a debt owed on a bank card, named the bank and stated that it was urgent that she call him to stop a judgment being filed against her.  As far as I can determine they have violated FDCPA.  Can you tell me if there are any circumstances under which they can divulge this information to a third party ?

There are NO circumstances that allows them to divulge information to a third party If you can catch them on tape violating the FDCPA your daughter could probably sue them or file a complaint with the FTC or state Attorney General. You need to be able to prove they broke the law so if you have other witnesses to this that may be sufficient.
