I HAVE A LOAN WITH A TITLE PAWN COMPANY IN GEORGIA, AND FELL LIKE 3 DAYS BEHIND ON MY LOAN.  THEY CAME TO MY JOB AND NOT ONLY ASKED FOR ME, BUT LIED AND SAID THEY HAD AN APPOINTMENT WITH ME.  WHEN I REFUSED TO SEE THEM THEY THEN TOLD THE SECRETARY AT MY WORK WHERE THEY WERE FROM AND THAT IT WAS PERTINENT THAT THEY SPEAK WITH ME.  I MYSELF WORK IN CREDIT AND COLLECTIONS, AND IM SURE THAT THIS IS AN INVASION OF MY PRIVACY.

Ok, lets be clear to our readers that when life gets so difficult financially that you have to deal with PAY HERE LOTS, PAWN SHOPS or TITLE LOANS, you are running into the real grey, if not black area of the Collection Business.

I want you to do the following:

I want you to send the company a certified letter demanding that they Cease and Desist and that they do not contact you at work prusuant to the FDCPA, Once they get this letter, they will be furious and I am sure they wil violate your rights again.  Then you will send a letter similar to this:

RE:    Notice of Failure to Comply with Cease and Desist
  RE:  

Sue Epley,

This letter will serve as an official notification that your office has violated the cease and desist that was tendered to your office via a telephonic conversation between myself and you and your associate XXXXX.  The call originated from our Salt Lake City Office and was directed to your Kansas Call center on December 26, xxxx.

Your office was also provided with a letter confirming the backup behind the reasoning for the cease and desist, and was provided with a written demand to cease and desist that was faxed and received by your office on December 26, 2001.  After faxing the document, I then called your office and you confirmed that you had indeed received the documents and that you would “take care” of this matter.

Yesterday, we received THREE demand letters from your office.  These letters were postmarked after the cease and desist order that was delivered to you by the debtor.  For your review, I am hereto attaching copies of each of the envelopes and the letters that were received.

As a matter of fairness and in an effort to mitigate your potential losses, I will permit you to supply me with a letter from your office stating that this matter has been indeed closed and that you will delete any and all delinquent ratings against my wife's account.  I would also ask that you supply me with a letter and a completed Universal Data Form confirming this arrangement.

Should you fail to comply with this request, I will have no other option than to protect the interests of our client.

Sue, the bottom line is that this is a very serious matter and everything is 100% documented.  I have given you a way out of this mess and would ask that you fax this letter to your policy and compliance officer if you feel inclined.

The deadline for the receipt of the letter via fax at 801-838-2583 is tomorrow, January 4, xxxx at noon Kansas Time.
