Collections Law - business credit debt/personal responsibility

Question Hello:
I owned a business that had two American Express accounts. My incorporated business went out of business and the debt owed on the AMEX cards is going unpaid. The collectors continue to call my home regarding this matter. (I was the owner of the business). I am wondering if I am now personally responsible for this "corporate" debt? I have written letters to both collectors explaining that the business went under and that I would appreciate them stopping the harassing phone calls (Up to 15 per day). As a point of interest, these two accounts (not paid since November '05) do not show up on my personal credit report. PLEASE HELP!!
Answer Good Evening Judy,
Dealing with American Express is a very complex process. I have been dealing with their Gold, Platinum and Black Divisions for 10 years.
It just so happens that American Express is located in SLC Utah, where I maintain an office for my company Western Capital.
With rare exceptions, most corporate obligations simply disappear at the point that the business closes and/or liquidates. However, AMEX most always requires a Personal Guarantee on all of their cards with exception for BLACK, which is a whole different conversation.
Dealing with the collectors is simple. Here is what I want you to do:
1. Send AMEX a certified letter asking for them to provide VERIFICATION of the debt. That means you want a copy of the ORIGINAL APPLICATION and copies of all statements AND copies of all charge slips that you signed that created the balance.
2. Send the collection agency a letter telling them that you are DISPUTING THE VALIDITY OF THE DEBT. DEMAND PROOF.
3. Send the collection agency that is handling the AMEX a letter to CEASE AND DESIST in calling you.
Send these in three separate envelopes and send certified.
Bottom line, you are most likely going to need a hard core person like myself to call the collection company and AMEX to get them to quit paying. If you are interested, just email me at robert.ceo@mycollector.com
