Question
Approx 1 yr ago, QVC took money from my bank account for items I did not order and did not receive.  I immediately changed my ATM/VISA number and my bank recovered the money.  Now a collection agency is threatening to take me to court.  I never ordered anything QVC and never received anything from QVC.  I am in California.  Can they really sue me?

Answer
You may dispute the validity of this debt and they must provide you with proof. This is federal law. If they can prove the debt is valid and you refuse to pay they may be able to get a judgment and attach wages or other assets. Send them a certified dispute letter with return receipt requested. Make them prove you owe the debt then take appropriate action based on their response. If they persist file a complaint with the Federal Trade Commission or your state Attorney General.
