Question
I have been divorced from my husband for 2 years and in December of 2006 I found out that my name was still on 2 of his credit cards. I asked him to remove my name since I had no access to the cards and had not been paying them.  He filled out a request form that was available online to have my name removed and mailed it in.  The credit card company refused to remove my name because he owed so much.  Now he has passed away and I am trying to negoiate with the company because I have not made these debts and I cannot pay them. Am I liable for these debts and if so, am I liable for the total amount on both the cards?  I live in North Carolina.

The question is were you just an authorized signer or were you on the original application and signed as a responsible party. If just an authorized signer tell them to go away. They haven't a leg to stand on. Write a letter to the company and demand proof you owe this debt. If they do not comply contact the Federal Trade Commission or State Attorney General and file a complaint. If it turns out you are obligated put your situation to paper and determine how much you can afford to pay. Make a proposal in writing for a payment plan or offer a lump sum settlement and send a copy of your budget to substantiate any hardship or tight budget.
