Question I live in Volusia county Florida and I recently had a credit card judgement against me for $1200 by a collections agency and now have a couple more trying to sue me. I have no income coming in, I own my mobile home which is on leased land and I do have an IRA for 13,000 and don't want to lose that since it's all I have. I recently remarried but this debt was made before I even met him and the debts are under my maiden name. They can't make my husband pay right? Can they go after my IRA? I have no money coming in myself and we are just about making ends meet now. I can afford an attorney. What can I do to stop these collection agencies from trying to sue me?

Thank you for taking the time to write me on your mess that you are in with your credit cards and the collection agencies.
Let me first state that your husband has no obligation to fulfill on yout premarital responsibilities, and you do not need to worry about that.
Next, the 13K in the IRA SOULD BE SAFE. The only way that I have EVER seen a debt collector get paid from an IRA, is when we, the collector, walked the debtor through the process of borrowing from the IRA. So, do not fall for that.
Your mobile home will more than likely fall under the homestead laws of Florida which are some of the toughest in the nation. How do you think that OJ Simpson lives in a multi million dollar home, plays golf, (Gets Arrested Again!) and does not pay the Goldman Judgment a god damn dime.
That pisses me off and if Ron Goldman reads this, call me, I will work this case for free. Believe me there is a lot of money in hiding in the OJ Simpson Case.
