Mr. Paisola,
Here is my predicament: 5 months ago, my husband and I spent our honeymoon in Maui.  The hotel room was obtained for us by the banquet manager of the hall where our reception was held.  This man promised us that he could get us a free room at the Hyatt in Maui; we did not get this in writing.  We arrived at the hotel to find our room booked for us by him with a credit card for the room charge.  He even called us the next day to verify that all was well and the room was completely free.  The whole vacation went off without a hitch.
Now, 5 months later, the hotel has contacted us because the $2700 room charges are being disputed and they want us to pay.  The credit card is not under the banquet manager's name (the hotel people did not say whose name it is, but is possibly a company card.)  Furthermore, the banquet manager's phone numbers have been disconected and he no longer works at that facility.  They say they have nothing in writng saying that the credit card was meant for anything more than to hold the room for us.  I feel that this is a complete scam, but I have no idea how to even proceed or what can legally be done.  We don't want to pay these charges, but we also don't want collections coming after us and damaging our credit.

Thanks for making the decision to write to me regarding your issue in Hawaii.

I have been thinking about your issue for the past hour and can not believe the depths that some companies will go to make a buck.

So, let me be kind, although I could be very hostile over this issue.

Here are the facts:

1.  You mada a decision to spend one of the the most important vacations of your life in Maui.  

2.  In order to gain your BANQUET business (which is a HUGE PROFIT CENTER FOR THE HOTEL) the property VIA ITS REPRESENTATIVE, made a series of deals and committments to gain your overall business.

3.  Part of the agreement was confirmed when you checked into the other property and YOU DID NOT USE YOUR CREDIT CARD.

4.  That alone, shows that there is no question that the resort that you paid to host your wedding event also provided the room as part of the package.

So, here is the bottom line, DO NOT PAY THEM ONE DIME. If they demand money from you in written form, I would like you to fax the letter to me at 408-889-2415 and email me all of your information and I will call the hotel for you.

I think you get the gist of where I am going with this. One thing that I can tell you is that this forumn is international in scope and we will happily mention the name of the hotel and all of the employees that were involved in this scam.  You may even wish to fax this letter to them along with my profile, and they will be able to see what happens to people that screw MY clients.
