I am stress about this issue on a Citibank (citicorp) visa I had in 1/96 (exp 1/98)that this collection agency (Unifund ccr partners)hired a lawyer (I live in Hawaii).. I met the law firm rep back in 1/05 saying I owe a debt of $3900 on a $1000 visa, but she said at our fisrt meeting that they would hold the amount there as we continue the case until they get more data from their client. NOW here is the problem I told them.. I Have the orginal statements until 4/98 with a bal of $1000.41 and I was paying $30 a month, I also had creditshield.. my balance was DROPPING about $7 a month... I had my bank do Automatic payments of $30/mo.. 44 months. the only things on the statements should be.. [bal+finance charge+creditshield-payments] later in 12/01 I called Citibank requesting back data (i called before i think in 1999 or 2000 but i dont remember much i was undergoing medical treatments)and that I needed to have the creditshield insurance to start for the 1/02 satements because I was getting open heart surgery and will be unemployed for 3-4 months. they said they will do what they can and we hung up. after i got back to work (may/02) and my first check I called and citibank sent the account to collection, saying I owed $2300+ and they cant deal with me any more, I was shocked and confused. sometime in 10/03 a person called my work claiming to be a collector, and they demand I send then 50% now and 50% next month. I asked first to send me the past data (Statements) so I can dispute anything odd. He said he didnt have the data and that I need to call citibank, I did and citibank said they sold the account and dont have the data anymore, I need to get it from the collector.. they dont know who has the debt. I called the so called collector back and asked again for the data... because i wanted to know how the credit card went from under 1000 and dropping to over 2000. He said he didnt have that info but needed my SSN. I thought this was odd.. and said "NO, you should have all my information IF you are real and bought the account, I refuse to deal with you anymore" He said we will sue you and garnish your wages.. I said... go ahead, because you sound like someone trying to steal my ID... I hung up. I got the summons in 11/04 and went to court in 2005. My 1st meeting went ok, we resch for 6/05 and another person from the law firm showed up with copies of statements from 4/00 - 6/01 and 6/02. he needed to reschedule.. for 1/06 to find more data, but we made copies of each others papers and exchanged them. 1/06 another person shows up and he didnt know much and resch for 4/06, in 4/06 we showed up in court and the lawyer wanted a date for summary judgement for 5/15/06. and said I now owe $4500+fees and penalities. He said "he dont need and cant get anymore data." the Judge help me a little by saying that I need to show up for that date and give compelling reason for NOT to grant judgement, then reshow of in his court to continue talks, depending on that other courts decision. NOW I'm streesed... the lawfirm will not deal and want the full amount owed... I dont belive I owe THAT much. My lawyer friend (not an expert in credit law) said that I should call Citibank as a 3rd party def. to explain why I didnt get the past statements, what hapened to the creditshield that didnt show in the collectors data, and why it went to collections a few months after I called.
I'm stuck on what to do in court...
How can I find what this unifund bought the orginal debt for?

This is a very serious matter,as you are in the middle of litigation on an issue that the collection agency and the original creditor can not even prove.
Kevin, under the law, you have the RIGHT to receive what we in the collection business as the MEDIA. This means that you must ask for a certified copy of the original agreement between you and citibank and also copies of each and every statement since the account was oppened. You also have the right to receive copies of eacg and every charge slip proving that YOU made the charges.
I want you to print this out and show this to the judge and to the attorney for the collection agency. Either they have ALL of the media or they have NONE of the media.
The buredon of proof is on the Collection Agency Plaintiff to VERIFY THE DEBT AND AN AFFIDAVID WILL NOT WORK.

If the court orderes a Summary Judgement against you based upon the worthless information you have received, I would immediately file a cross complaint and depose the hell out of Every person at citibank that ever dealt with you.

Thanks for writing me again.
Ok, lets look at this issue clearly.
As a consumer you have the ability to demand that the collection agency provide you with all of the data that they have to support the debt that they are collecting on.
In other words, simply sending you a printout of the debt from their computer system will not cut it anymore.
You are entitled to receive
a. A copy of the ACTUAL SIGNED CARDHOLDER AGREEMENT that proves you are the debtor
b. A copy of each and every statement that they have sent you since the account was opened.
c. A COPY OF EACH AND EVERY SIGNED CHARGE SLIP THAT PROVES THAT YOU ARE THE ONE THAT SIGNED FOR THE TRANSACTION.
This is what MEDIA is. Most debtors have no clue what to ask for. This is provided under the Fair Debt Collection Practices Act.
I will be in Honolulu next Tuesday for an event. I believe that I received your letter from email also. So bear with me as I am working hard to keep this massive service project alive, and at the same time travel the world for speaking engagements.
Lastly Kevin, I want you to take 45 minutes and LISTEN to three calls that took place yesterday between me and a collection agency named ALLIED INTERSTATE. This company had NO IDEA who I was and if you listen to the calls you will see why I am creating a CLASS ACTION LAWSUIT against them
