Question
In Texas can a collection/law firm take legal action against me civil court for credit card debt? If they can sue would it be a civil suit? I get calls daily from several of these collection/law firms who say they are going to pursue legal action if I don't settle or pay them a large monthly payment for unsecured credit cards. I have offered to make small monthly payments but they refused the amount.

Answer
Dear Sir or Madam:

Yes, a law firm can sue you in Texas for an unsecured credit card debt.  However, they cannot garnish wages or attach property so far as I am aware.  Therefore, the likelyhood of them doing so is rather remote.  However, it would be a civil action should they elect to proceed.
